NEET UG Exam: The Delhi High Court on Tuesday declined to entertain a petition seeking the conduct of the National Eligibility cum Entrance Test (NEET) Undergraduate (UG) examination twice a year, similar to the Joint Entrance Examination (JEE) Main for engineering aspirants.
A bench comprising Chief Justice D K Upadhyaya and Justice Tushar Rao Gedela ruled that the decision to hold the NEET UG examination more than once a year falls within the administrative domain and is a policy matter beyond the court’s purview.
“It is for the authorities to consider the prayer. That’s a policy decision by the government,” the bench stated while disposing of the petition. However, the court granted liberty to the petitioner, a coaching center teacher, to approach the relevant authorities with a formal representation.
The court further noted that if such a representation was submitted, the authorities must consider it and take an appropriate decision in accordance with the law.
NEET UG Petition’s Arguments
The petitioner argued that JEE (Main) is conducted multiple times a year, allowing students to improve their scores and reducing psychological pressure. By contrast, NEET UG aspirants are granted only a single attempt annually, which increases stress and limits their chances of admission to medical colleges.
The plea emphasized that medical aspirants should also have more than one opportunity to appear for the exam, similar to their engineering counterparts, to enhance their chances of securing admission and improve their performance.
